In these Terms, unless the context indicates otherwise:

“Animals” / “Game” means wildlife or game listed, marketed, or discussed via this Website or through direct engagement with Spitzkop Wild.

“Transaction” means any sale, supply, transfer, relocation, collection, delivery, booking, or service agreement concluded with Spitzkop Wild.
2.1. This Website is intended to provide information about Spitzkop Wild and may showcase animals for sale and animals previously sold.
2.2. The Website may function as a catalogue. Any purchase, reservation, or arrangement is subject to availability, confirmation, and may require written acceptance by Spitzkop Wild.
2.3. You may not use this Website for any unlawful purpose or in a way that may harm Spitzkop Wild, its operations, reputation, systems, or other users.

Listings are provided for general information and may change at any time.
Animal measurements (including horn length), ages, weights, and related details may be approximate, subject to field conditions and standard measurement variation.
3.2. Photographs and videos are for marketing and identification purposes and may differ from the animal’s appearance in different seasons, lighting, or conditions.
3.3. We do not guarantee that any animal shown on the Website will remain available. Availability may change without notice.
4.1. Any enquiry you submit (via forms, email, or other communication) is treated as a request for information only and does not create a binding agreement.
4.2. Prices, deposits (if applicable), transport options, and other transaction terms may be provided by quote. A quote is only valid for the period stated in the quote or, if not stated, for a reasonable period.
4.3. Spitzkop Wild may accept, decline, or withdraw any enquiry or quotation at our discretion, subject to applicable law.
If Spitzkop Wild engages in a sale or transfer of wildlife/game to you, the following terms apply unless amended in writing:
A sale is only confirmed once Spitzkop Wild has provided written confirmation (email confirmation is sufficient) and all required conditions have been met (including payment, documentation, and permit requirements where applicable).
5.2.1. Payment terms (including any deposit requirements and final balance due dates) will be communicated to you in writing.
5.2.2. If payment is not received by the agreed deadlines, Spitzkop Wild may cancel the transaction without further obligation, subject to any lawful deductions, costs incurred, or contractual terms already agreed to in writing.
5.3.1. Wildlife/game transactions may be subject to industry rules and legal requirements, including permits, movement documentation, and compliance obligations under applicable conservation and environmental laws.
5.3.2. Unless expressly agreed otherwise in writing, you are responsible for ensuring you have the lawful authority, permits, approvals, and destination readiness to receive, keep, relocate, or manage the animal(s).
5.3.3. Spitzkop Wild will reasonably cooperate by providing documentation and confirmations we lawfully can, where required and applicable.
5.4.1. Collection or delivery arrangements must be agreed in writing.
5.4.2. Where third-party transport providers or contractors are used, they act independently. Spitzkop Wild is not responsible for delays, failures, losses, or damages caused by independent third parties, to the extent permitted by law.
5.4.3. Unless agreed otherwise in writing:
Risk may pass at the point of collection from Spitzkop Wild, or
Risk may pass at the point the animal is loaded for transport / handed over to the transport provider.
5.4.4. Any timelines provided are estimates only. Wildlife logistics may be affected by weather, operational realities, animal behaviour, safety conditions, and permit processes.
5.5.1. Wildlife/game animals are living animals with natural behaviours and conditions that may change over time.
5.5.2. Spitzkop Wild does not provide guarantees regarding:
future horn growth, breeding performance, temperament, adaptability, or behaviour;
performance outcomes;
health outcomes after handover, relocation, transport, or environmental changes.
5.5.3. By proceeding, you acknowledge the inherent risks involved in wildlife/game handling, movement, and management.
6.1. Due to the nature of wildlife/game transactions, returns are not permitted once an animal has been transferred, relocated, collected, or delivered.
6.2. Any cancellation terms, including potential forfeiture of deposits or recovery of costs, will be handled according to written agreements and actual costs incurred, subject to applicable law.
6.1. If you visit Spitzkop Wild premises by arrangement, you do so at your own risk.
6.2. You must comply with all instructions, safety rules, and access requirements issued by Spitzkop Wild or our representatives.
6.3. Spitzkop Wild is not liable for injury, loss, damage, or incidents arising from unsafe conduct, failure to follow instructions, or wildlife-related risks, to the maximum extent permitted by law.
7.1. All content on this Website (including text, images, logos, listings, marketing copy, designs, and branding) is owned by Spitzkop Wild or lawfully licensed.
7.2. You may not copy, reproduce, republish, distribute, reverse engineer, or commercially exploit the Website content without prior written permission.
You agree not to:
misuse the Website or attempt to gain unauthorised access to systems or data;
upload malicious code, viruses, or harmful scripts;

Spitzkop Wild will not be liable for delays or failure to perform due to causes beyond reasonable control, including (but not limited to) weather events, transport disruptions, compliance delays, operational risks, animal welfare concerns, or regulatory processes.
We may update these Terms from time to time. The latest version will apply from the date published on the Website. Continued use of the Website means you accept the updated Terms.
These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of South African courts for any dispute arising from these Terms or your use of this Website.
